Three persons accused of vandalising multi-million naira property of the Power Holding Company of Nigeria were on Wednesday arraigned before the Federal High Court in Ibadan. Witnesses were also called in the continued hearing of a similar matter involving four separately accused who had been standing trial for allegedly carting away PHCN property on March 28, 2006.
The two cases were heard by Justice Benedicta I. Molokwu.
The accused: Jimoh Alao, Madubuike Samuel and Tunde Idris, were brought to court on a two-count charge. They were accused of conspiracy and tampering with electric poles, cable wires, bolt and nuts belonging to PHCN on October 25, 2007.
The offence is contrary Section 3 (6) of the Miscellaneous Offences Act Cap m17 Laws of the Federal Republic of Nigeria 2004. They were also alleged to have vandalizing electric poles, cable wires, bolts and nuts, which were property of PHCN. The offence is contrary to section 1(9) of the miscellaneous offences Act Cap m17, vol.9 Laws of the FRN 2004.
The trial of the accused was, however, stalled, following an oral application by the state lawyer, Mr. E. Ehichioya, to amend the charges. Granting his request, Justice Molokwu said she would welcome a written application and adjourned the matter till April 28.
